1. APPLICABILITY

1.1. This User Agreement, along with the Terms of Service (collectively referred to as the "User Agreement"), outlines the terms and conditions for using the services and products of Journey Intels Travel Solutions (OPC) Private Limited and JOURNEY INTELS TRAVEL MANAGEMENT (PTY) LTD (collectively referred to as "Journey Intels").

1.2. Any individual ("User") who inquires about or purchases any products or services through Journey Intels's websites, mobile applications, sales representatives, offices, call centers, branch offices, franchisees, or agents (collectively referred to as "Sales Channels") agrees to be governed by this User Agreement. The websites and mobile applications of Journey Intels are collectively referred to as the "Website."

1.3. Both the User and Journey Intels are individually referred to as a "Party" and collectively as the "Parties" to this User Agreement.

1.4. The "Terms of Service" available on Journey Intels's website detail terms & conditions applicable to various services or products facilitated by Journey Intels. Users should review the relevant Terms of Service for the specific product or service booked. These Terms of Service are binding on the User.

2. ELIGIBILITY TO USE

2.1. Users must be at least 18 years old and have the legal capacity to enter into an agreement. If you are under 18, you should not register as a User or use the Website. If a minor wishes to use or transact on the Website, it must be done by a legal guardian or parent. Journey Intels reserves the right to terminate access if it is discovered that a User is a minor or if age information provided at account creation is false.

2.2. Users must read and understand this User Agreement before using the Website or engaging with Journey Intels's Sales Channels. Acceptance of this User Agreement is required to proceed. If you disagree with any part of this Agreement, you must not use Journey Intels’s services or access its Sales Channels.

2.3. All rights and obligations of the User and Journey Intels are limited to the scope of this User Agreement.

3. CONTENT

3.1. All content provided through Journey Intels’s Sales Channels, including but not limited to audio, images, software, text, and icons ("Content"), is registered by Journey Intels and protected under applicable intellectual property laws. Users may only use this Content as specified in this Agreement.

3.2. Users must follow all instructions provided by Journey Intels regarding the use of Content. Proprietary logos, service marks, and trademarks displayed on the Website are not licensed to Users for any use. Unauthorized use of Content will violate applicable laws.

4. WEBSITE

4.1. The Website is intended for lawful use by bona fide Users.

4.2. Users shall not distribute, exchange, modify, sell, or transmit any material from the Website for any commercial or public purpose. Journey Intels grants a limited, non-exclusive, non-transferable right to use the Website as expressly permitted. Users agree not to disrupt the Website's operation.

4.3. Certain features may be available only to registered Users, who may need to provide personal information. Journey Intels reserves the right to terminate access to the Website for maintenance or other reasons.

4.4. While Journey Intels strives to ensure the Website is free from viruses or malware, Users download or obtain information at their own risk. Journey Intels is not liable for any damage resulting from such actions.

4.5. Users should report any unlawful or objectionable content on the Website to report@journeyintels.com. Journey Intels will investigate and take appropriate action.

5. BOOKINGS BY TRAVEL AGENTS

5.1. Travel agents, tour operators, consolidators, or aggregators ("Travel Agents") must be registered with Journey Intels and receive explicit permission to use the Website for commercial purposes. Unauthorized bookings by Travel Agents will be canceled, and payments or refunds will be withheld. Journey Intels is not liable for losses arising from such bookings. Discounts and offers on the Website are valid only for legitimate bookings by Users.

6. LIMITED LIABILITY OF JOURNEY INTELS

6.1. Journey Intels acts primarily as a facilitator connecting Users with service providers like airlines, hotels, and bus operators. Journey Intels's liability is limited to providing a confirmed booking as selected by the User. Issues with services are the responsibility of the Service Providers. Journey Intels does not guarantee the quality, availability, or accuracy of services provided by third parties.

7. USER'S RESPONSIBILITY

7.1. Users should review service descriptions carefully before booking. Users are bound by the conditions in the booking confirmation or voucher and must inform others on whose behalf they are booking about this Agreement. Users must comply with all relevant laws and guidelines.

7.2. Services are provided on an "as is" and "as available" basis. Journey Intels may change features or functionality without prior notice. Journey Intels disclaims all warranties, whether express or implied.

7.3. Users consent to being contacted by Journey Intels through various communication methods for transaction-related information and support.

8. SECURITY AND ACCOUNT RELATED INFORMATION

8.1. Users are responsible for maintaining the confidentiality of their password and account. Journey Intels is not liable for unauthorized use of accounts. Users should notify Journey Intels of any security breaches immediately.

8.2. Journey Intels encrypts payment information but cannot guarantee security against breaches. Personal information may be shared with third parties for processing and legal purposes.

9. FEES AND PAYMENT

9.1. Journey Intels may charge convenience or service fees in addition to the cost of bookings. Users are responsible for all charges, including taxes and fees. Any short-charging or additional charges will be addressed according to applicable policies.

9.2. Payments should only be made to Journey Intels’s official bank accounts. Journey Intels is not liable for any transactions made to unauthorized accounts. Refunds will be processed to the original payment method.

10. USAGE OF MOBILE NUMBER AND COMMUNICATION DETAILS

10.1. Journey Intels will use mobile numbers and communication details provided by Users for booking confirmations, updates, and other relevant information. Users consent to receive such communications and indemnify Journey Intels against any claims related to these communications.

11. INSURANCE

11.1. Obtaining insurance coverage is the User’s responsibility unless explicitly provided by Journey Intels. Any insurance offered is subject to third-party terms and conditions. Journey Intels facilitates connections with insurance providers but is not liable for claims.

12. TCS Compliance

12.1 TCS on Overseas Tour Packages:

'Overseas tour package' means any tour package which offers a visit to a country or countries or territory or territories outside India and includes expenses for travel, hotel stay, boarding, lodging, or any other expenditure of similar nature or in relation thereto.

‘Specified Person’ means a person defined as per provisions of Section 206CCA(3) of Income Tax Act, 1961.

The User is liable to pay Tax Collected at Source (TCS) on booking of an ‘Overseas tour package’ at an appropriate rate over and above the price charged for such package in compliance with the provisions of Section 206C (1G)(b) of the Income Tax Act, 1961. Journey Intels will deposit the TCS amount so collected with the Government and issue an appropriate document/certificate to the User in compliance with the aforesaid provision.

The User is required to provide a valid PAN of User/Traveler(s) at the time of booking an overseas tour package with Journey Intels. The User understands and agrees that Journey Intels, at the time of booking or at a later stage, will validate the PAN provided by the User to check compliance with provisions of Section 206CC of Income Tax Act. The User agrees that in case the PAN is found to be invalid, or it does not belong to User/traveler(s), Journey Intels has an obligation to cancel the booking in compliance with the law and process the refund as per the cancellation policy applicable to said booking.

The User further understands and agrees that Journey Intels would also, at the time of booking or at a later stage, validate User/traveler(s) PAN as per the provisions of Section 206CCA of Income Tax Act and if on validation the User qualifies as a ‘Specified Person,’ the User agrees to pay TCS to Journey Intels at such higher rate as may be applicable under Section 206CCA. The User agrees to pay the additional TCS amount to Journey Intels where, as a result of validation under Section 206CCA, the TCS collected at the time of booking falls short of the applicable rate of TCS. If User fails or disagrees to pay the additional TCS, Journey Intels has the right to cancel the booking and process the appropriate refund as per the cancellation policy applicable to such booking.

12.2 Compliance of Liberalized Remittance Scheme (LRS)

The RBI mandates the collection of PAN details for all transactions made under the Liberalized Remittance Scheme (LRS), which includes any international booking made on the Website or through Sales Channels. The User warrants and confirms that PAN details of the User/traveler will be shared with Journey Intels on or before the cut-off date prescribed by Journey Intels either at the time of booking or after the booking is made. In case the traveler is a minor, Journey Intels will require PAN details of the parent/guardian of such minor. The User further confirms that non-compliance with this requirement may result in the cancellation of the booking.

The User warrants and confirms that the total amount of foreign exchange purchased or remitted during the current financial year, through all sources in India (including the current transaction) falls within the permissible limit prescribed by the RBI. In case the limit gets breached before the actual remittance request is approved by the AD Bank, Journey Intels has an obligation to cancel the booking in compliance with the law and process a refund as per the cancellation policy applicable to said booking. The User further confirms that foreign exchange, if any, purchased by the User for the purpose of international travel under the current booking will be utilized for the purpose indicated above.

The User authorizes Journey Intels to retrieve User’s/Traveler’s (in case booking on someone’s behalf) PAN details from User’s profile, previous bookings, or share User/traveler’s data with third parties for collecting or verifying PAN details solely for the purposes mentioned in this Agreement.

The User understands Journey Intels does not collect User’s PAN details without consent. If the User wishes to opt-out of providing the same or wishes to delete it if already provided, the User may do so by accessing the profile information through the Desktop.

The User authorizes Journey Intels to share User/traveler data with third parties for collecting or verifying PAN details of User/traveler.

13. Obligation to Obtain Visa

International bookings made through Journey Intels are subject to the requirements of visa, including but not limited to transit visa, OK TO BOARD, which are to be obtained by the User as per the requirement of their travel bookings and the requirements of the countries the User intends to visit or transit through.

Journey Intels is not responsible for any issues, including inability to travel, arising out of such visa requirements and is also not liable to refund any amount to the User for being unable to utilize the booking due to absence or denial of visa, irrespective of whether or not the User has availed of Journey Intels’ services for the visa process. Refunds, if any, will be as per the applicable terms of booking and cancellation policy.

14. Force Majeure

There can be exceptional circumstances where Journey Intels and/or the Service Providers may be unable to honor the confirmed bookings due to reasons such as act of God, labor unrest, insolvency, a pandemic, an epidemic, business exigencies, government decisions, terrorist activity, operational and technical issues, route and flight cancellations, etc., or any other reason beyond the control of Journey Intels. If Journey Intels has advance knowledge of any such situations where dishonor of bookings may happen, it will make its best efforts to provide a similar alternative to the User or refund the booking amount after deducting applicable service charges, if supported and refunded by the respective service operators. The User agrees that Journey Intels, being merely a facilitator of the services and products booked, cannot be held responsible for any such Force Majeure circumstance. The User must contact the Service Provider directly for any further resolutions and refunds.

The User agrees that in the event of non-confirmation of booking due to any technical reasons (like network downtime, disconnection with third-party platforms such as payment gateways, banks, etc.) or any other similar failures, Journey Intels’ obligation shall be limited to refunding the booking amount, if any, received from the customer. Such a refund shall completely discharge Journey Intels from all liabilities with respect to that transaction. Additional liabilities, if any, shall be borne by the User.

In no event shall Journey Intels be liable for any direct, indirect, punitive, incidental, special, or consequential damages, and any other damages like damages for loss of use, data, or profits, arising out of or in any way connected with the use or performance of the Website or any other Sales Channel.

15. Advertisers on Journey Intels, and Linked Websites

The Website may contain links to third-party websites. Journey Intels does not control such websites and is not responsible for their contents. If a User accesses any third-party website, the same shall be done entirely at the User's risk, and Journey Intels shall assume no liability for the same.

Journey Intels is not responsible for any errors, omissions, or representations on any of its pages, links, or any linked website pages to the extent such information is updated or provided directly by the Service Providers or the advertisers.

Journey Intels does not endorse any advertisers on its Website or any linked sites in any manner. The Users are requested to verify the accuracy of all information provided on the third-party web pages.

The linked sites are not under the control of Journey Intels, and hence Journey Intels is not responsible for the contents of any linked site(s) or any further links on such site(s), or any changes or updates to such sites. Journey Intels is providing these links to the Users only as a convenience.

16. Right to Refuse

16.1 Right to Refusal by Journey Intels:

Journey Intels, at its sole discretion, reserves the right to not accept any booking without assigning any reason thereof.

Journey Intels will not provide any service or share confirmed booking details until such time the complete consideration is received from the User.

In addition to other remedies and recourse available to Journey Intels under this User Agreement or under applicable law, Journey Intels may limit the User's activity, warn other users of the User's actions, immediately suspend or terminate the User's registration, or refuse to provide the User with access to the Website if:

  • The User is in breach of this User Agreement; or
  • Journey Intels is unable to verify or authenticate any information provided by the User; or
  • Journey Intels believes that the User's actions may infringe on any third-party rights or breach any applicable law or otherwise result in any liability for the User, other users of Journey Intels, or Journey Intels itself.

Once a User has been suspended or terminated, such User shall not register or attempt to register with Journey Intels with different credentials, or use the Website in any manner whatsoever until such User is reinstated by Journey Intels. Journey Intels may at any time in its sole discretion reinstate suspended users.

If a User breaches this User Agreement, Journey Intels reserves the right to recover any amounts due to be paid by the User to Journey Intels, and to take appropriate legal action as it deems necessary.

The User shall not write or send any content to Journey Intels which is, or communicate with Journey Intels using language or content which is:

  • Abusive, threatening, offensive, defamatory, coercive, obscene, belligerent, glorifying violence, vulgar, sexually explicit, pornographic, illicit or otherwise objectionable;
  • Contrary to any applicable law;
  • Violates third parties' intellectual property rights;
  • A spam; or
  • In breach of any other part of these terms and conditions of use.

If the User violates any of the aforesaid terms, Journey Intels shall be at liberty to take appropriate legal action against the User.

16.2 Right to Refusal by End Service Provider:

The User agrees that the end service provider may refuse to provide the service(s) agreed to be provided to the User for any booking made through Journey Intels with/without assigning any reasons or owing to reasons including but not limited to behavioral issues, public safety, health hazards, infectious diseases, government orders/notifications, etc. In such scenarios of refusal, the liability that may ensue shall solely vest with the end service provider as it is outside the purview of Journey Intels and the User agrees that any claim, refund, or damages against such refusal shall lie solely against the end service provider and not Journey Intels.

17. Right to Cancel

17.1 The User expressly undertakes to provide Journey Intels with correct and valid information while making use of the Website under this User Agreement and not to make any misrepresentation of facts. Any default on the part of the User would disentitle the User from availing the services from Journey Intels.

17.2 In case Journey Intels discovers or has reasons to believe at any time during or after receiving a request for services from the User that the request for services is either unauthorized or the information provided by the User or any of the travelers is not correct or that any fact has been misrepresented by that User, Journey Intels shall be entitled to appropriate legal remedies against the User, including cancellation of the bookings, without any prior intimation to the User. In such an event, Journey Intels shall not be responsible or liable for any loss or damage that may be caused to the User or any other person in the booking, as a consequence of such cancellation of booking or services.

17.3 If any judicial, quasi-judicial, investigation agency, or government authority approaches Journey Intels to cancel any booking, Journey Intels will cancel the same without approaching the concerned User whose booking has been cancelled.

17.4 The User shall not hold Journey Intels responsible for any loss or damage arising out of measures taken by Journey Intels for safeguarding its own interest and that of its genuine customers. This would also include Journey Intels denying or cancelling any bookings on account of suspected fraud transactions.

18. Fake Calls and Other Similar Phishing, Spamming, or Fraudulent Activities

18.1 Journey Intels' employees or authorized representatives will never contact a User asking for their credit or debit card number, expiry date, CVV, net banking login, passwords, OTP, etc., nor will they ever request a fund transfer to a personal or individual bank account. Further, they will also not ask a User to install any third-party applications that enable them to view a User's mobile or computer screen.

18.2 Acting on any of these requests may make you a victim of fraud and may potentially lead to the loss of your valuable money or information.

18.3 If you are ever asked for any of the aforesaid information, please report it immediately to riskcontrol@journeyintels.com.

19. Indemnification

19.1 The User agrees to indemnify, defend, and hold harmless Journey Intels, its affiliates, and their respective officers, directors, lawful successors, and assigns from and against any and all losses, liabilities, claims, damages, costs, and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by such indemnified persons, that arise out of, result from, or may be payable by virtue of, any breach of any representation or warranty provided by the User, or non-performance of any covenant by the User.

19.2 The User shall be solely liable for any breach of any country-specific rules and regulations or general code of conduct, and Journey Intels cannot be held responsible for the same.

COVID-19 Related Terms & Conditions

18.1 User agrees that due to the recent outbreak of the COVID-19 pandemic, which has been declared a national disaster by the Government of India, there may be instances where the end service provider either cancels the booking or refuses to provide the services as agreed with the User, by assigning or not assigning any specific reason for such refusal. Refusal of service may be due to reasons including but not limited to the User:

  • Exhibiting any symptoms associated with COVID-19.
  • Refusing to comply with safety advisories, such as wearing protective gear, complying with social distancing norms, etc.
  • Suffering from any ailment making the User vulnerable to the virus.
  • Posing a threat to the health and safety of others.

18.2 In such cases, Journey Intels will assume no liability for the refusal of service by the end service provider. The User also agrees that any refund for such bookings will be processed by Journey Intels to the User subject to receipt of the same from the end service provider.

18.3 User further understands that due to the outbreak of COVID-19, the Central Government, through its ministries, State Governments, and statutory bodies, may come up with detailed guidelines or standard operating procedures (SOP) that a traveler will have to follow in order to undertake travel.

18.4 The User agrees to abide by all such guidelines/SOPs while undertaking any travel. Failure to abide by such detailed guidelines/SOPs may lead to a situation where the service provider or any person authorized by the Central Government, State Government, or statutory body may disallow the User from undertaking the travel. In such circumstances, Journey Intels will not be held liable for such refusal to travel, and any refund shall be strictly as per the terms of the service provider.

18.5 User understands that the Central Government, State Governments, and various other bodies may mandate downloading the Arogya Setu App or submitting a self-declaration form prior to entering a transit point like an airport, railway station, etc., or at the time of checking into a flight, hotel, etc. Accordingly, the User must ensure downloading of the Arogya Setu App on their smartphones or provide any other alternate such as a self-declaration when demanded.

18.6 User undertakes that all bookings are subject to certain minimum medical wellbeing criteria specified by the Government or appropriate authority from time to time. User should have no medical history of the COVID-19 virus 28 days before the date of scheduled travel, especially in the case of inbound travel. In this regard, the User may be required to furnish medical proof or health declaration in an applicable format.

UPI Related Terms & Conditions

19.1 Journey Intels acts as a Third Party Application Provider (TPAP) under UPI.

19.2 Journey Intels is a TPAP authorized by NPCI to facilitate payments through PSP Bank(s). For this purpose, ICICI Bank and IndusInd Bank shall act as the PSP. Journey Intels participates in UPI through the PSP Bank.

19.3 Through the agreement entered into between Journey Intels, ICICI/IndusInd, and NPCI, Journey Intels shall facilitate grievances, complaints, and provide resolution to the customers using our UPI application.

19.4 Journey Intels shall act as the first point of contact for all UPI-related grievances/complaints for its UPI customers. In the event the complaint or grievance remains unresolved, the User may escalate the issue to ICICI Bank/IndusInd Bank, followed by the User’s bank (linked to the UPI account) and NPCI thereafter, in the same order. If the User is still dissatisfied, the User may approach the Banking Ombudsman and/or the Ombudsman for Digital Complaints, as the case may be.

FAQs

19.5 What is NPCI?
 National Payments Corporation of India (NPCI) is an authorized payment system operated by RBI. NPCI owns and operates the UPI payment system.

19.6 What is PSP Bank?
 Payment Service Provider (PSP) is the banking company authorized to act as a service provider under the UPI framework. PSP engages the Third Party Application Provider (TPAP) to provide UPI services to the end-user customers.

19.7 What are TPAPs?
 Third Party Application Provider (TPAP) is an entity that provides the UPI-compliant app(s) to the end-user customers to facilitate UPI-based payment transactions.

19.8 What is the Customer’s Bank?
 The bank where the end-user customer maintains their account that has been linked for the purpose of debiting/crediting the payment transactions made through UPI.

19.9 Who is the End-User Customer?
 The end-user customer is the individual who uses the UPI payment facility to send and receive payments.

General Terms Pertaining to the Use of UPI

19.10 Roles & Responsibilities of NPCI

  • NPCI owns and operates the Unified Payments Interface (UPI) platform.
  • NPCI prescribes rules, regulations, guidelines, and the respective roles, responsibilities, and liabilities of the participants, with respect to UPI. This includes transaction processing and settlement, dispute management, and clearing cut-offs for settlement.
  • NPCI approves the participation of Issuer Banks, PSP Banks, Third Party Application Providers (TPAPs), and Prepaid Payment Instrument issuers (PPIs) in UPI.
  • NPCI provides a safe, secure, and efficient UPI system and network.
  • NPCI provides online transaction routing, processing, and settlement services to members participating in UPI.
  • NPCI can, either directly or through a third party, conduct audits on UPI participants and call for data, information, and records in relation to their participation in UPI.
  • NPCI provides the banks participating in UPI access to a system where they can download reports, raise chargebacks, update the status of UPI transactions, etc.

19.11 Roles & Responsibilities of PSP Bank

  • PSP Bank is a member of UPI and connects to the UPI platform for availing UPI payment facility and providing the same to the TPAP, which in turn enables the end-user customers/merchants to make and accept UPI payments.
  • PSP Bank, either through its own app or TPAP’s app, on-boards and registers the end-user customers on UPI and links their bank accounts to their respective UPI ID.
  • PSP Bank is responsible for the authentication of the end-user customer at the time of registration of such customer, either through its own app or TPAP’s app.
  • PSP Bank engages and on-boards the TPAPs to make the TPAP’s UPI app available to the end-user customers.
  • PSP Bank has to ensure that TPAP and its systems are adequately secure to function on the UPI platform.
  • PSP Bank is responsible to ensure that the UPI app and systems of TPAP are audited to safeguard the security and integrity of the data and information of the end-user customer, including UPI transaction data and UPI app security.
  • PSP Bank has to store all payments data, including UPI Transaction Data, collected for the purpose of facilitating UPI transactions, only in India.
  • PSP Bank is responsible for providing all UPI customers with an option to choose any bank account from the list of banks available on the UPI platform for linking with the customer’s UPI ID.
  • PSP Bank is responsible for putting in place a grievance redressal mechanism for resolving complaints and disputes raised by the end-user customer.

19.12 Roles & Responsibilities of TPAP

  • TPAP is a service provider and participates in UPI through PSP Bank.
  • TPAP is responsible for complying with all the requirements prescribed by PSP Bank and NPCI in relation to TPAP’s participation in UPI.
  • TPAP is responsible for ensuring that its systems are adequately secure to function on the UPI platform.
  • TPAP is responsible for complying with all applicable laws, rules, regulations, and guidelines prescribed by any statutory or regulatory authority in relation to UPI and TPAP’s participation on the UPI platform, including all circulars and guidelines issued by NPCI in this regard.
  • TPAP has to store all the payments data, including UPI Transaction Data, collected by TPAP for the purpose of facilitating UPI transactions, only in India.
  • TPAP is responsible for facilitating RBI, NPCI, and other agencies nominated by RBI/NPCI, to access the data, information, and systems of TPAP related to UPI and carry out audits of TPAP, as and when required by RBI and NPCI.
  • TPAP shall facilitate the end-user customer with an option to raise grievances through the TPAP’s grievance redressal facility made available through TPAP’s UPI app or website and such other channels as may be deemed appropriate by the TPAP like email, messaging platform, IVR, etc.

     19.14 If any provision of this User Agreement is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this User Agreement shall continue to be in full force and effect.
  • JURISDICTION
     19.15 This Agreement is subject to interpretation as per the laws of India, and the parties shall refer any unresolved disputes to the exclusive jurisdiction of the courts in Bihar.
  • AMENDMENT TO THE USER AGREEMENT
     19.16 Journey Intels reserves the right to change the User Agreement from time to time. The User is responsible for regularly reviewing the User Agreement.
  • CONFIDENTIALITY
     19.17 Any information which is specifically mentioned by Journey Intels as confidential shall be maintained confidentially by the User and shall not be disclosed unless as required by law or to serve the purpose of this User Agreement and the obligations of both parties herein.
  • FEEDBACK FROM CUSTOMER
     19.18 Journey Intels would like to know the feedback of the Users for improving its services. The User hereby authorizes Journey Intels to contact the User for their feedback on various services offered by Journey Intels. Such feedback may be collected through emails, telephone calls, SMS, or any other medium from time to time. In case the User chooses not to be contacted, such User shall write to Journey Intels for specific exclusion at privacy@journeyintels.com.
  • PRIVACY POLICY
     19.19 User shall also refer to Journey Intels' Privacy Policy available on Journey Intels' website which governs the use of the Websites. By using the Website, User agrees to the terms of the Privacy Policy and accordingly consents to the use of the User’s personal information by Journey Intels and its affiliates in accordance with the terms of the Privacy Policy.
  • GRIEVANCE REDRESSAL
     19.20 Journey Intels strongly believes in resolving the issues raised by the User(s). In the event if user feels that its concern has not been resolved to its satisfaction, User may contact our grievance officer, who shall endeavor to redress the concern within 30 days from the date of escalation. To reach the grievance officer, please use this link to submit the details. User(s) are advised to escalate to the grievance officer only when they have already raised their complaint which has not been resolved to their satisfaction, or their concern has not been resolved within 30 days from the date of ticket generation. User(s) will be required to share their booking reference number and the ticket ID generated for their complaint, for any escalations to the Grievance Officer through this link.

20.1 General Terms
 The airline tickets available through the Website are subject to the terms and conditions of the concerned airline, including but not limited to cancellation and refund policies.

20.2 Role of Journey Intels
 Journey Intels merely acts as a facilitator to enable the User to book a flight ticket. The contract of service for utilization of the flight is always between the User and the concerned airline.

20.3 Airline Control
 Airlines retain the right to reschedule flight times, routes, change or cancel flights or itineraries independent of and without prior intimation to Journey Intels. As a facilitator, Journey Intels has no control or authority over the logistics of the airlines and therefore is not liable for any loss, direct or incidental, that a User may incur due to such change or cancellation of a flight.

20.4 Ticket Restrictions and Baggage Allowance
 Different tickets on the same airline may carry different restrictions or include different services and prices. The baggage allowance on the given fare is as per the terms decided by the airline, and Journey Intels has no role in the same. Some of the fares shown in the booking flow are "hand baggage fares" which do not entitle the User for free check-in baggage; therefore, the User will be required to pay separately for check-in baggage. The prices for adding check-in baggage to a booking may vary from airline to airline. The User is advised to contact the airlines for detailed costs.

20.5 Code Share Agreements
 Some airlines enter into "code share" agreements with other airlines. This means that on certain routes, the airline carrier selling or marketing the flight ticket does not fly its own aircraft to that destination. Instead, it contracts or partners with another airline to fly to that destination. The partner airline is listed as "operated by" in the booking flow. If your flight is a code share, it will be disclosed to you in the booking process and prior to payment. Journey Intels will disclose any such code-share arrangements to the User only when the ticketing airline discloses it to Journey Intels in the first place.

20.6 Pricing
 The total price displayed on the Website on the payment page usually includes base fare, applicable government taxes, and convenience fee. Users are required to pay the entire amount prior to the confirmation of their booking(s). In the event the User does not pay the entire amount, Journey Intels reserves its right to cancel the booking. User agrees to pay all statutory taxes, surcharges, and fees, as applicable on the date of travel. To avail of infant fares, the age of the child must be under 24 months throughout the entire itinerary. This includes both onward and return journeys. If the infant is 24 months or above on the return journey, the User will be required to make a separate booking using a child fare. Any infants or children must be accompanied by an adult as per the terms of the airlines.

20.7 Travel Documents
 It shall be the sole responsibility of the User to ensure they are in possession of valid travel documents such as identity proof, passport, visa (including transit visa), etc., to undertake the travel. User agrees that in case of inability to travel for not carrying valid travel documents, Journey Intels shall in no way be held liable. User understands that the information (if any) provided by Journey Intels regarding the travel documents is only advisory in nature and can't be considered conclusive. The User shall ensure checking the requirements of travel with the respective airlines of the respective jurisdictions the User may transit through or choose to visit.

20.8 Check-In Terms
 User should check with the airlines directly regarding the check-in timings. Usually, check-in begins 2 hours before departure for domestic flights, and 3 hours before departure for international flights. User should carry valid identification proofs, passport, and age proofs as may be required to prove the identity, nationality, and age of the passengers traveling on a ticket, including infants.

20.9 Use of Flight Segments
 In the event the User does not embark on the onward journey, the entire PNR pertaining to that booking shall be automatically cancelled by the airline. In such a scenario, Journey Intels has no control in the said process nor will be obligated to provide alternate bookings to the User. The cancellation penalty in such an event shall be as per the applicable airline rules.

20.10 Changes to Existing Booking
 Any changes that are made to any existing booking shall be subject to certain charges levied by the respective airline, apart from the service fee charged by Journey Intels. The User shall be obligated to pay applicable charges in the event of any alteration or modification to an existing booking. However, depending on the airline's policy and fare class, charges for changes or modifications to existing bookings may vary.

20.11 Refund
 Refunds will be processed as per the airline fare rules and cancellation policy. Such refunds shall be subject to Journey Intels receiving the same from the airlines. However, the convenience fee paid to Journey Intels at the time of booking is a non-refundable fee. All cancellations made directly with the airline need to be intimated to Journey Intels in order to initiate the process of refund. The processing time for refunds may vary depending on the mode of payment, bank, etc. The refund shall be processed after deducting the Journey Intels service fee which is independent of the convenience fee as mentioned above. The refund will be credited to the same account from which the payment was made. For example, if the User used a credit card, Journey Intels will make an appropriate charge reversal to the same credit card; likewise, if the User used a debit card, Journey Intels will credit the money to the same debit card. In the event of cancellation and refund of partially utilized tickets, upfront discount and promo code discount availed at the time of booking would be deducted from the refund amount.

CHARTER

TERMS OF THE CHARTER COMPANY

21.1 General Terms
 Charter facility means and includes the booking or hiring of an entire jet/aircraft/helicopter as available with the Charter Company. The Charter facility booked through the Website is subject to the terms and conditions of the concerned Charter Company, including but not limited to cancellation and refund policies. The same will be communicated to the User at the time of booking and also through the booking confirmation voucher.

21.2 Role of Journey Intels
 The User acknowledges that Journey Intels merely acts as a facilitator to enable the User to book a Charter. The contract of service is always between the User and the concerned Charter Company.

21.3 Charter Booking Terms
 The booking will be governed by terms decided by the Charter Company, and the Charter Company reserves the right to cancel or reschedule the charter booked on account of events like bad weather conditions, lockdown, operational requirements, or if there is any unforeseen technical/mechanical problem. An alternate charter is subject to availability and is the sole prerogative of the Charter Company of which Journey Intels has no control. Any difference in the fare will be payable based on the fare existing at the time of rescheduling the charter flight.

21.4 Facilities Onboard
 Carry-on luggage/baggage allowance, boarding & lodging facilities, number of passengers, food, etc., are as per the terms of the Charter Company, and Journey Intels has no role to play in the same. Journey Intels may facilitate the communication on the requests of the User to the Charter Company; however, fulfillment of those requests is entirely the prerogative of the Charter Company.

21.5 Changes to Existing Bookings
 Any changes to an existing booking will be subject to the charges levied by the Charter Company. The User shall be obligated to pay applicable charges in the event of any alteration or modification to an existing booking.

21.6 Travel Document
 User understands that the Charter Company requires passenger names, nationality, passport number, date of issue, and date of expiry, medical reports, etc., well in advance to obtain necessary security clearances and to undertake the travel. User also understands that inability to travel on account of not carrying valid travel documents or refusal to board shall be solely attributable to the User, and Journey Intels shall in no way be held liable for the same.

 Journey Intels acts as a facilitator and merely provides an online platform for Users to select and book a particular hotel. This includes all categories of accommodations such as hotels, home-stays, bed and breakfast stays, farmhouses, and any other alternate accommodations.

21.2 Information Provided by Hotels
 All information pertaining to the hotel—including its category, images, room type, amenities, and facilities—is provided by the hotel to Journey Intels. This information is for reference only. Any discrepancies between the website pictures and the actual settings of the hotel should be raised directly with the hotel and resolved between the User and the hotel. Journey Intels is not responsible for such discrepancies and will not take any liability for the same.

21.3 Booking Confirmation and Liability
 The hotel booking voucher issued by Journey Intels is based on information provided or updated by the hotel regarding inventory availability. Journey Intels cannot be held liable for failure on the part of a hotel to accommodate the User with a confirmed booking, or for the standard of service, insufficiency in services, or any other issues at the hotel. In the event of denial of check-in by the hotel due to reasons such as over-booking, system or technical errors, or unavailability of rooms, Journey Intels’ liability is limited to providing a similar alternate accommodation at its discretion (subject to availability) or refunding the booking amount (to the extent paid). Other service-related issues should be resolved directly with the hotel.

21.4 Hotel Admission Policies
 Hotels reserve the sole right of admission, and Journey Intels has no influence over admission decisions. Some hotels may not allow unmarried or unrelated couples to check-in as per their policies. Similarly, accommodation may be denied to guests posing as a couple if suitable proof of identification is not presented at check-in. Some hotels may also deny check-in to local residents. Journey Intels will not be responsible for check-in denials due to these reasons or any other reasons beyond its control. No refund will be applicable if the hotel denies check-in under such circumstances.

21.5 User Responsibilities
 The User is responsible for any damages caused by them or their guests (willful/negligent) to the property of the hotel. The extent and amount of damage will be determined by the hotel, and Journey Intels will not intervene. The primary guest must be at least 18 years old to check into the hotel. The User must present a valid identity proof and address proof at check-in. The hotel has the right to deny check-in if valid identification is not presented. Check-in and check-out times are as per hotel policy and any changes are subject to availability. Early check-in or late check-out requests may incur additional charges.

21.6 Additional Charges by the Hotel
 The booking amount paid by the User is only for the stay at the hotel. Some bookings may include breakfast and/or meals as confirmed at the time of booking. Any additional services utilized at the hotel, including laundry, room service, internet, telephone, extra food, drinks, etc., shall be paid directly to the hotel. Hotels may charge a mandatory meal surcharge during festive periods, and such charges must be settled directly with the hotel. Journey Intels has no control over waiving these charges.

21.7 Payment for Bookings and Additional Payments
 Hotel bookings can be "Prepaid" or "Pay at hotel" as per the options available on Journey Intels' Website.

In the "Prepaid" model, the total booking amount is paid at the time of booking and includes the hotel reservation rate, taxes, service fees charged on behalf of the actual service provider, and any additional booking or convenience fees charged by Journey Intels. At the hotel's or Journey Intels' discretion, a part payment may be required at booking confirmation, with the balance to be paid as per booking terms. For security, Users must provide correct credit or debit card details. Journey Intels may cancel the booking if details are found incorrect.

Payment can be made in INR or other specified currencies. Some banks and card issuers may charge transaction fees for international payments. Users should contact their bank or card issuer for details on fees or exchange rates. Some accommodation suppliers may require a credit card or cash deposit upon check-in for additional expenses unrelated to Journey Intels' payments.

In the "Pay at hotel" model, the hotel collects the payment at check-in. International bookings may be charged in local or other currencies as decided by the hotel. For security, Users must provide correct credit or debit card details, and Journey Intels may cancel the booking if details are incorrect.

BUS

ROLE OF JOURNEY INTELS

22.1 General Terms
 Journey Intels provides a technology platform that connects travelers with bus operators. It does not operate buses or offer transportation services directly. Journey Intels is not an agent for any bus operator.

22.2 Booking Confirmation
 The bus ticket booking voucher issued by Journey Intels is based on information provided or updated by the bus operator regarding seat availability. Amenities, services, routes, fares, schedules, bus types, seat availability, and other details are provided by the bus operator, and Journey Intels has no control over this information.

LIMITATION OF LIABILITY OF JOURNEY INTELS

22.3 Bus Operations
 Journey Intels shall not be responsible for the bus operator's operations, including:

  • Timely departure or arrival of the bus;
  • Conduct of the bus operator's employees, representatives, or agents;
  • Condition of the bus, seats, or other aspects not meeting the customer's expectations or descriptions;
  • Cancellation of trips for any reason;
  • Loss or damage to customer baggage;
  • Changes in seat assignments;
  • Incorrect boarding point information or changes without notification;
  • Use of separate vehicles for transport to the bus departure point.

RESPONSIBILITIES OF THE USERS

22.4 User Responsibilities
 Users should confirm the exact boarding point and other necessary details with the bus operator. At boarding, Users must present a copy of the ticket and valid identification (Aadhar card, passport, PAN card, voter ID, or any other government-issued ID). Users should arrive at least 30 minutes before the scheduled departure time. Tickets are non-transferable. Children above 5 years require a separate ticket unless otherwise specified by the bus operator.

22.5 Ticket Cancellation
 Tickets can be canceled via the Journey Intels website, mobile app, or customer care number. Cancellation is subject to charges specified on the ticket.

CABS

DEFINITIONS

23.1 Cab Definition
 "Cab" includes all categories of transport vehicles like sedans, hatchbacks, sport utility vehicles, multi-utility vehicles, and any other vehicle meant for transporting passengers.

23.2 Cab Operator Definition
 "Cab Operator" means all operators providing their vehicles along with drivers.

TYPES OF CAB BOOKINGS FACILITATED BY JOURNEY INTELS

23.3 Booking Options
 Journey Intels provides the following cab booking options:

  • Outstation Cab: For travel between cities with vehicles having All India Tourist Permits (AITP).
  • Car Rental (Intracity and Intercity): Vehicles available for hire or rental basis, both intracity and intercity.
  • Airport Drop: Service for travel to and from the airport within a city.

ROLE OF JOURNEY INTELS AND LIMITATION OF LIABILITY

23.4 General Terms
 Journey Intels does not operate cab services. It connects Users with Cab Operators and acts solely as a facilitator. The transaction is between the Cab Operator and the User. Cab Operators are responsible for obtaining necessary licenses, approvals, insurance, and permits.

23.5 Liability Limitations
 Journey Intels is not responsible for:

  • Timeliness, safety, or quality of cab services;
  • Conduct of the Cab Operator's employees or representatives;
  • Conditions of the cab or driving skills;
  • Cancellations or delays;
  • Loss, theft, or damage to baggage;
  • Incorrect boarding point information or changes;
  • Accidents or other issues caused by the Cab Operator.

23.6 Refunds for Breakdowns or Accidents
 In case of breakdown or accident where the Cab Operator cannot provide alternative arrangements, Journey Intels will provide a proportionate refund for the uncovered distance. Claims or legal costs arising from such events are the responsibility of the Cab Operator.

24. PAYMENT FOR BOOKINGS AND ANY ADDITIONAL PAYMENTS

24.1 Booking Models:
 Booking of a Cab with Journey Intels can be made under the following models:

  • Prepaid Model: The total booking amount, including base fare, applicable taxes, and any additional fees, is paid at the time of booking.
  • Part Payment Model: The User pays a specified percentage of the total booking amount at the time of booking. The remaining balance is to be paid directly to the driver at check-in.

24.2 Cancellation Policy:
 All bookings are subject to the cancellation policy provided at the time of booking.

24.3 Additional Costs:
 For Car Rental and Outstation Cab bookings, the amount paid does not include additional expenses such as toll charges, interstate taxes, passenger taxes, or any other applicable levies. These costs are to be borne by the User and paid directly to the driver.

24.4 Additional Expenses:
 Expenses such as toll charges, permit charges, parking charges, entry fees, service tax, and any other government taxes must be paid directly to the driver.

24.5 Final Pricing:
 The estimated cost provided at the time of booking may change based on actual usage (kilometers and hours). The final amount will be calculated based on actual usage from garage to garage, not from the pick-up location. Travel allowances, where applicable, must be paid directly to the driver.

25. RESPONSIBILITIES OF THE USERS

25.1 Identification:
 The User must carry a valid photo ID and present it to the Cab Operator or driver before boarding. In case of identity mismatch, the Cab Operator or driver may deny boarding.

25.2 Trip Commencement:
 The Cab Operator is obligated to start the trip as soon as the User boards. If the driver refuses to commence the trip, the User must report it to Journey Intels.

25.3 Boarding Time:
 Users must board the Cab within the time frame provided. Failure to board within the given timeline may result in cancellation of the booking without notice.

25.4 Rights and Interests:
 Users have no rights, title, or interest in the Cab provided for the trip.

25.5 Changes and Cancellations:
 Once a trip is booked, changes to departure time, boarding, or drop-off points are not permitted. Failure to board within the given time results in forfeiture of the total booking amount with no refund rights.

25.6 Breaks and Safety:
 Users must stop and take breaks only at specified locations. Additional breaks are only allowed in emergencies. Users are responsible for their safety and the security of their luggage. Journey Intels is not liable for any loss to Users or their luggage.

25.7 Reporting Issues:
 Dissatisfaction with services should be reported directly to the Cab Operator or Journey Intels for resolution.

25.8 Booking Purposes:
 Bookings must be made strictly for tourism purposes and not for commercial profit-making.

26. DO's AND DON'Ts FOR THE USER

26.1 DOs:

  • Arrive on time at the agreed pick-up point.
  • Maintain good conduct with the Cab Operator; failure to do so may result in being asked to disembark.
  • Check and agree with the Cab Operator on luggage dimensions/weight before the trip.
  • Verify the starting time and odometer reading at the start of the trip. Disputes regarding these will not be accepted post-journey.

26.2 DON’Ts:

  • Request the Cab Operator to violate any traffic, city police, or government rules.
  • Coerce the Cab Operator to overload the vehicle with luggage.
  • Use the services for unlawful purposes.
  • Insist on disembarking at a location other than the specified drop-off point.
  • Board the Cab if intoxicated or under the influence of drugs or similar substances.

27. TRAIN

27.1 Role of Journey Intels:
 Journey Intels acts as a facilitator for train ticket bookings, providing Users with a platform to search and book tickets through IRCTC. All bookings are subject to the Terms & Conditions set by Indian Railways.

27.2 Control and Liability:
 Journey Intels does not control the booking process, scheduling, cancellations, or seat/berth allotments. Any issues in these areas are the responsibility of Indian Railways.

27.3 Changes and Downtime:
Changes to the boarding point and passenger names are not supported. For ticket amendments, visit IRCTC's ticket amendment page. Train functionality on Journey Intels' website may be unavailable between 23:45 and 00:30 hours or as specified by IRCTC.

28. RESPONSIBILITIES OF THE USERS

28.1 IRCTC Credentials:
 Users will be redirected to the IRCTC website/app to input their credentials during booking. Users must remember their IRCTC username and password.

28.2 E-Tickets:
 E-tickets are issued through Indian Railways. Users can book up to 6 seats/berths per booking. Seat/berth allocation is done by Indian Railways. Journey Intels does not guarantee seat preferences.

28.3 Valid ID Proofs:
 Only passengers with confirmed e-tickets can board the train. Valid ID proofs are required at travel or boarding.

28.4 Information and Queries:
For information on bookings, visit IRCTC or Indian Railways.

29. PAYMENTS FOR BOOKINGS AND CANCELLATIONS

29.1 Service Charges:
 Journey Intels' service charges are non-refundable.

29.2 Cancellation Policy:
 Cancellations must be made via the app or website; offline cancellations are not permitted. Bookings are subject to Indian Railways' cancellation policies and charges, varying by cancellation time and booking quota.

29.3 Refunds:
 Fully waitlisted e-tickets are automatically canceled after chart preparation. Refunds are credited to the bank account used for booking, minus Journey Intels' charges.

29.4 Concessions:
 Special concessions for senior citizens, female passengers, and children are determined by Indian Railways. Users should check current railway policies for applicable discounts.

30. ACTIVITIES AND OTHER SERVICES

30.1 Definitions:
 'Activity' includes day tours, sightseeing, spa services, adventure sports, cruises, theme parks, buffets, and dining or any other service/product booked via the Website.

30.2 Role of Journey Intels and Limitation of Liability:
 Journey Intels acts as a facilitator for procuring Activity services from Activity Providers. The relationship between the User and the Activity Provider is separate from Journey Intels' involvement. Journey Intels does not provide pick-up and drop facilities unless explicitly mentioned.

30.3 Exclusions of Liability:
 Journey Intels is not liable for:

  • Any damage, loss, injury, or delay/change in schedule due to conditions beyond the Activity Provider's control.
  • The health, safety, and well-being of the User during the Activity.
  • Any incidental services purchased directly from the Activity Provider.
  • Incorrect information provided by the Activity Provider.

The maximum liability of Journey Intels is limited to the refund of the booking amount received for the Activity reservation.

  • Journey Intels is not liable for personal injury, sickness, accidents, loss, theft, or delays affecting the User or their belongings. It also is not responsible for issues with co-travelers, airlines, hotels, or transportation services.
  • The maximum liability of Journey Intels is limited to the total booking amount paid by the User.
  • In exceptional circumstances where service operators are unable to honor bookings, Journey Intels will attempt to provide alternatives or refund the booking amount, subject to service provider policies.

RESPONSIBILITIES OF THE USERS

30.4 Waivers and Consent Forms:
 Before participating in the Activity, the User may be required to sign a waiver/consent form, safety procedure form, medical declaration, or other documents as mandated by the Activity Provider. These documents are necessary for acknowledging risks and ensuring compliance with safety protocols.

30.5 Direct Communication:
 Subsequent to the confirmation of the reservation, the User should directly contact the Activity Provider for any concerns or issues related to the Activity. Journey Intels is not responsible for resolving issues that arise after the reservation is confirmed and the Activity Provider has been engaged.

30.6 Eligibility Criteria:
 The User must ensure they meet all eligibility criteria for participating in the Activity, including but not limited to age limits, weight restrictions, and medical conditions. If the User is found unfit or ineligible, the Activity Provider may refuse participation at their discretion.

PAYMENTS FOR BOOKINGS AND CANCELLATIONS

31.1 Cancellation and Refund Policies:
 Reservations are subject to the cancellation and refund policies of the Activity Provider. These policies may change over time, and it is the User’s responsibility to review them prior to making a booking.

31.2 Additional Charges:
 Journey Intels may charge applicable taxes, service fees, convenience fees, and other charges as per the Activity Provider’s requirements. These charges are in addition to the cost of the booking.

SPECIAL OFFERS AND COUPONS

32.1 Coupon Terms and Conditions:

  • Journey Intels’ responsibility is limited to providing the coupon to the User upon receipt of payment. The redemption process is the User’s responsibility, and the Activity Provider will handle the service provision.
  • Coupons will have an expiry date mentioned on them. The User cannot use the coupon after this date.
  • Coupons are non-redeemable for cash and are not eligible for refunds or cancellations once purchased.

VISA SERVICES

33.1 Role of Journey Intels and Limitation of Liability:

  • Journey Intels acts as a facilitator for visa processing and is not responsible for visa approval or rejection decisions. The issuance of a visa is determined solely by the relevant Embassy or consulate.
  • Journey Intels provides information on visa requirements based on details from the embassy or high commission. It does not advise on the completeness or suitability of documents or the likelihood of visa approval.
  • The User is responsible for ensuring that visa applications are submitted in a timely manner to secure a visa before the departure date.
  • Passport and visa requirements vary by country and may change without notice. Journey Intels will strive to provide accurate and current information but is not liable for any inaccuracies or changes.

33.2 Embassy Decisions:

  • The approval or rejection of a visa is at the sole discretion of the embassy or consulate. Journey Intels has no role in the assessment or processing of the visa application.
  • The User may be required to attend a face-to-face interview at the embassy or consulate. Journey Intels will inform the User about the interview details but will not participate in the process.

33.3 Third-Party Vendors:

  • Journey Intels may engage third-party vendors for visa applications. These vendors are responsible for processing the application and may refuse to submit it if they believe there is a risk of rejection based on the User’s credentials. Additional documents may be required, and the application will proceed only upon receipt of these documents.

33.4 Passport Delivery:

  • For visas requiring passport submission, Journey Intels will ensure safe delivery of the passport to the User. However, Journey Intels is not liable for any loss or misplacement of the passport during transit.

33.5 Visa Service Countries:

  • The list of countries for which Journey Intels offers visa services is available on their website and is subject to change.

33.6 Limitation of Liability:

  • Journey Intels is not responsible for delays or non-issuance of visas by embassies or consulates, nor for any incidental costs incurred by the User due to visa issues. Even if a visa is issued, local immigration authorities have the final say on entry decisions.

33.7 OK TO BOARD Approval:

  • Certain countries may require an "OK TO BOARD" approval. Journey Intels facilitates this process but has no control over the approval or rejection of the "OK TO BOARD" request. The User must provide valid contact information for timely updates on the status of their "OK TO BOARD" application.

RESPONSIBILITIES OF THE USERS

34.1 Authorization:

  • By using Journey Intels for visa application facilitation, the User authorizes Journey Intels to file the visa application and pay the associated fees on their behalf.

34.2 Document Submission:

  • The User must promptly provide all required documents for visa processing and ensure their authenticity and accuracy. Journey Intels is not responsible for verifying the documents’ authenticity.

34.3 Information Accuracy:

  • The User is required to provide all necessary and accurate information for processing the visa application, including personal details, contact information, and travel plans.

34.4 Verification of Visa Details:

  • Upon receiving their passport and documents from Journey Intels, the User must verify that all visas have been obtained and that the details are correct and match their travel itinerary.

34.5 Reapplication for Rejected Visas:

  • If a visa application is rejected and the User wishes to reapply or appeal, Journey Intels will process this strictly based on the User’s instructions. Reapplication will incur applicable fees and will be considered a new transaction.

34.6 Vendor Refusal:

  • If a third-party vendor appointed by Journey Intels refuses to submit the User’s visa application due to document issues, the visa fee will be refunded, but Journey Intels’ service fee will remain non-refundable.

PAYMENTS AND OTHER CHARGES

35.1 Service Fees:

  • Journey Intels charges a service fee for visa processing, in addition to visa fees, embassy charges, and other fees. This service fee is non-refundable, even if the User decides not to proceed with the visa application or if the application is rejected.

35.2 Additional Charges:

  • Any additional costs for services such as document pickup, passport collection, or courier charges will be payable separately by the User.

35.3 Changes in Fees:

  • Embassy fees, taxes, and other charges are subject to changes made by embassies or government authorities without prior notice. Journey Intels is not liable for these changes, and such charges are non-refundable after the visa application has been submitted.

OUTBOUND AND DOMESTIC TOURS

36.1 Definitions:

  • Independent Contractors: Refers to entities such as hoteliers, airline operators, shipping companies, and other service providers engaged to offer services to the User.
  • Outbound Tour: A tour organized by Journey Intels outside of India, including but not limited to brochure tours, special tours, packages, cruises, and sightseeing.
  • Tour Cost: The total cost of all services booked by the User for an outbound tour.
  • Booking Fees: A non-refundable fee or token money deposited by the User at the time of booking.
  • Brochure: Any document detailing the itinerary and activities included in an outbound tour.
  • Infant and Child: Definitions for booking purposes where an infant is below 2 years old and a child is between 2 and 12 years old.

36.2 Role of Journey Intels and Limitation of Liability:

  • Journey Intels does not control or operate any airlines, hotels, transport vehicles, or other services mentioned in the brochure. It is not responsible for delays, service issues, or damages caused by Independent Contractors.
  • Journey Intels will not be liable for personal injury, sickness, accidents, loss, theft, or delays affecting the User or their belongings, or for issues arising from the actions of co-travelers. The maximum liability of Journey Intels is limited to the total amount paid for the booking.
  • In exceptional circumstances where service operators cannot honor bookings due to reasons such as climatic conditions, labor unrest, or other issues, Journey Intels will attempt to offer alternative arrangements or a refund, subject to the policies of the service providers involved. The User must contact the service provider directly for further resolutions and refunds.
  • BROCHURE
  • 36.3 Changes to Brochure Information:
     All information provided in the Brochure is based on data available at the time of its publication. Journey Intels reserves the right to amend any information contained in the Brochure before or after booking due to events beyond Journey Intels' control.
  • 36.4 Notification of Changes:
     If Journey Intels becomes aware of any changes before departure for an Outbound Tour, it will take reasonable steps to notify the User. If changes are discovered after departure, the Journey Intels tour manager or local representative will inform the User.
  • 36.5 Price Adjustments:
     The prices in the Brochure are calculated based on the rates prevailing at the time of publication. Journey Intels reserves the right to amend these prices due to currency fluctuations, changes in gross exchange rates, fuel costs, special/high season charges by suppliers, or increases in airline/rail charges before the departure date. All price increases must be paid in full by the User before departure.
  • 36.6 Additional Terms and Conditions:
     Apart from these Terms of Service and the User Agreement, specific terms and conditions related to each Outbound Tour are detailed on the Website, in email communications, and in confirmed booking vouchers. These additional terms are also part of the Journey Intels User Agreement and must be read in conjunction with these terms.
  • 36.7 Claims Against Brochure Changes:
     No claim against any changes in the Brochure will be entertained if such changes result from circumstances beyond Journey Intels’ control.
  • MEALS AND SPECIAL REQUESTS
  • 37.1 Pre-set Menus:
     Meals during the Outbound Tour are pre-set as indicated in the Brochure. Journey Intels does not guarantee the availability of special meals or diets except as mentioned in the Brochure.
  • 37.2 Menu Changes:
     Journey Intels reserves the right to change the menu if necessary. If the User is unable to avail of the meals provided, no claim for unutilized meals can be made against Journey Intels.
  • 37.3 Breakfast Policy:
     Hotels serve breakfast at varying local times as specified in the confirmed booking voucher. Breakfast is not available for room delivery or packing. If the User misses breakfast, no claim will be entertained.
  • 37.4 Special Requests:
     Journey Intels may accommodate special meal requests or room allocations based on availability and service provider agreements. If such requests are not fulfilled, Journey Intels is not liable. Any extra costs for special requests must be borne by the User.
  • 37.5 Charges for Special Meals:
     If the User opts for special meals or additional requests, any extra charges incurred must be paid by the User and cannot be recovered from Journey Intels.
  • 37.6 Fault of Journey Intels:
     If the User does not receive a meal due to Journey Intels’ fault, Journey Intels’ liability is limited to the proportionate amount paid for the meal during the booking.
  • HOTELS IN THE OUTBOUND TOUR
  • 38.1 Hotel Selection:
     Journey Intels selects hotels based on internal assessments and strives to provide details in advance. Journey Intels reserves the right to change hotels before booking based on availability or other reasons beyond its control.
  • 38.2 Hotel Category Disputes:
     Once a hotel category or star rating is confirmed, no disputes regarding the hotel's category or type will be entertained. Journey Intels is not liable for any inconvenience or discomfort due to hotel service inadequacies.
  • 38.3 User Liability for Hotel Damage:
     Users are responsible for any damage caused to hotel property by themselves or their guests. The hotel will determine the extent and amount of damage, and Journey Intels will not intervene.
  • 38.4 Hotel Change Requests:
     No requests for hotel changes will be entertained once booking is confirmed. If the User upgrades or changes hotels independently, they must bear the additional charges and cannot claim these from Journey Intels.
  • 38.5 Baggage and Valuables:
     Users are responsible for their own baggage and valuables. Journey Intels is not liable for any loss or theft of baggage or personal items during hotel stays or the tour.
  • ITINERARY
  • 39.1 Proposed Itinerary:
     A proposed itinerary will be provided before booking and may be subject to changes. The confirmed itinerary and hotel vouchers provided after full payment will be final.
  • 39.2 Price Adjustments:
     The Outbound Tour price may increase if rates change before departure. Users must pay any incremental costs before departure.
  • 39.3 Itinerary Details:
     The itinerary is subject to hotel and airline availability. No claims regarding the full utilization of the last day or tour inclusion will be entertained.
  • 39.4 Changes to Itinerary:
     Journey Intels will make reasonable efforts to ensure the itinerary is convenient and comfortable but reserves the right to alter it if necessary. Any changes beyond Journey Intels’ control post-departure will be communicated to the User, but Journey Intels is not responsible for losses incurred.
  • 39.5 Additional Expenses:
     Journey Intels reserves the right to claim additional expenses due to delays or changes in the itinerary caused by any reason.
  • 39.6 Itinerary Alterations:
     Journey Intels can amend, alter, or withdraw any part of the itinerary, including departure, excursions, hotels, or other aspects, if deemed necessary.
  • 39.7 Missed Activities:
     Journey Intels will not refund any money for missed activities due to User delays. Changes in the itinerary post-booking are not entertained except at Journey Intels’ discretion and subject to availability, with additional costs borne by the User.
  • COACH AND SITTING
  • 40.1 Coach Use:
     Coaches are used for transfers and local sightseeing. No seat numbers are allocated, and Users must follow the Tour Manager’s instructions.
  • 40.2 Personal Belongings:
     Users should not leave valuable personal items on the coach. Journey Intels is not liable for loss of items left behind. Users are responsible for their baggage and any damage caused to the coach.
  • 40.3 Driver Regulations:
     Drivers have specific rules regarding maximum driving hours and rest periods. Users must adhere to the timetable to avoid missed sightseeing.
  • 40.4 Coach Breakdown:
     In case of a coach or vehicle breakdown, Journey Intels will provide an alternative within a reasonable time but is not liable for delays or additional issues caused by breakdowns or traffic.
  • TIPPING
  • 41.1 Customary Tipping:
     Tipping is customary for services (e.g., porters, guides) and is at the User’s discretion unless stated otherwise in the Brochure.
  • 41.2 Mandatory Tipping:
     In Europe and the UK, tipping local guides, waiters, and tour managers is customary. A nominal tipping amount of 2 Euros per person per day for Europe and the UK, and 2 Dollars per person per day for the USA, is expected for coach drivers.
  • CURRENCY AND TRAVELERS CHEQUES
  • 42.1 Recommended Currency:
     Users should carry a combination of local currency, traveler’s cheques, and travel currency cards. Traveler’s cheques are safe and replaceable if lost, while travel currency cards offer 24/7 access to cash at ATMs.
  • ACCOMMODATION FOR CHILDREN BELOW 12 YEARS
  • 43.1 Bed Provision:
     If a child under 12 years of age is booked without paying for a separate bed, no separate bed will be provided at the hotel.
  • BOOKINGS THROUGH THIRD PARTY/TRAVEL AGENTS
  • 44.1 Authorization:
     If a travel agent signs the booking form on behalf of the User, it is deemed that the User has authorized the travel agent to do so. The booking form signed by the agent is binding on the User.
  • 44.2 Travel Agent Contract:
     For bookings through a travel agent, the contract is with the travel agent, and Journey Intels is a supplier to the agent. Journey Intels is not responsible for claims arising from non-receipt of information if the contact number is unreachable or incorrect.
  • 44.3 Promises by Travel Agents:
     Journey Intels is not liable for promises made by travel agents authorized by the User. All products and services are provided according to the Brochure or other documents provided at the time of booking.
  • 44.4 Refunds through Travel Agents:
     Refunds, if any, will be made to the travel agent through whom the User booked the tour.
  • FORFEITURE OF DEPOSITS
  • 45.1 Non-refundable Booking Fee:
     Journey Intels may require a non-refundable booking fee at the time of booking. Cancellation charges apply if the User cancels the booking or fails to adhere to the payment schedule.
  • 45.2 Visa Rejections:
     In case of visa denial, Journey Intels may recover costs incurred for bookings by deducting cancellation charges. These charges cover expenses incurred by Journey Intels for making reservations at the User's request.
  • CANCELLATION DUE TO VISA REJECTION
  • 46.1 Visa Requirements:
     Users must possess valid visas for all countries visited as part of the tour. If a visa is not granted, Users must notify Journey Intels immediately.
  • 46.2 Reapplication and Appeals:
     If a visa is rejected, Journey Intels will deduct cancellation charges and additional visa expenses. If the User wishes to reapply or appeal, Journey Intels will process this based on the User’s instructions, with applicable fees for the reapplication or appeal.
  • CANCELLATION CHARGES
  • 47.1 Application of Cancellation Charges:
     Cancellation charges will apply for any cancellation of the Outbound Tour, including visa rejection or voluntary cancellation by the User, as detailed in the Brochure or itinerary.
  • PAYMENT OF THE TOUR COST
  • 48.1 Payment Schedule:
     Payment for the tour shall be made according to the payment schedule provided in the brochure, email, or any other documented information communicated at the time of booking.
  • 48.2 Payment Methods:
     Payments can be made either online or via demand draft (DD) or cheque as specified to the User.
  • 48.3 Currency:
     Payments can be made in INR or any other foreign exchange/currency, as specified in the brochure or other documented information provided at the time of booking. Journey Intels relies on various outbound service providers and independent contractors for planning the tour.
  • 48.4 Dishonored Cheques:
     If a cheque towards payment is dishonored, Journey Intels reserves the right to cancel the entire booking without notice and without any liability, and will pursue appropriate legal remedies.
  • 48.5 Final Documents:
     Final documents and airline tickets will be provided only after the balance payment is received. For payments amounting to Rs. 25,000/- or more made by cash, a PAN card copy will be required.
  • 48.6 Foreign Exchange Component:
     For calculating the cost of the tour or refunds, the foreign exchange components will be based on the prevailing exchange rate on the day of calculation. Any fluctuations in the rate of exchange may affect the cost of the tour or the refund amount, which the User must bear.
  • 48.7 Invoice Breakdown:
     Journey Intels is not obligated to provide a breakdown of the invoice for each service included in the package.
  • REFUNDS
  • 49.1 Refund Facilitation:
     Journey Intels acts as a facilitator for refunds. Refunds for services not delivered by the service provider or independent contractors are subject to Journey Intels receiving the amount from these providers. Journey Intels is not liable for delays or non-refunds by service providers, and Users must approach the service provider directly for claims.
  • 49.2 Accommodation Changes:
     No refunds or compensations will be provided if Users make changes to their accommodation while on the tour. Any additional sums required due to these changes must be paid by the User.
  • 49.3 Delay in Refunds:
     If a refund is delayed beyond the specified period, Journey Intels' liability is limited to the refund amount with interest calculated at the applicable bank rate until the refund is made.
  • AMENDMENTS
  • 50.1 Tour Amendments:
     If Journey Intels amends or alters any tour or holiday after booking, the User may choose to continue with the amended tour or accept an alternative tour offered by Journey Intels.
  • 50.2 Liability for Amendments:
     Journey Intels will not be liable for any damage, additional expenses, or consequential losses suffered due to amendments. The liability is limited to refunding the tour cost after deducting actual expenses incurred by Journey Intels (e.g., visa, insurance premiums, other charges) without interest.
  • PROMOTION & DISCOUNTS
  • 51.1 Promotions and Discounts:
     Journey Intels may offer promotions and discounts on tour packages through advertisements or internal schemes. Users in group tours may receive additional benefits based on such promotions. Claims for discounts or promotions not received due to ineligibility will not be entertained.
  • 51.2 Withdrawal of Schemes:
     Journey Intels reserves the right to withdraw any travel scheme or discount at any time.
  • TOUR ARRANGEMENTS & OTHER ACTIVITIES
  • 52.1 Terms and Conditions:
     For arrangements such as carnival, cosmos, star cruises, amusement parks, museums, etc., the terms and conditions specified by the respective entities will apply.
  • 52.2 User Responsibility:
     Users must reach the commencement place of the tour and register with Journey Intels’ representative, tour guide, or tour manager at the appointed place, date, and time.
  • 52.3 No Show Policy:
     If a User avails pre-tour services or air tickets included in the main tour cost but fails to join the group for the main tour or cancels after using these services, it will be considered a "no show," and no refund will be provided for unutilized pre-tour or main tour services.
  • 52.4 Liability for Activities:
     Journey Intels is not liable for any health, safety, or well-being hazards associated with activities including adventure sports, amusement parks, rides, ferry rides, sightseeing, or any activity undertaken during the tour or independently. Any incidental damage, loss, injury, or death is the sole responsibility of the User.
  • MISCELLANEOUS
  • 53.1 Withdrawal of Tour Membership:
     Journey Intels reserves the right to withdraw tour membership from any User whose behavior affects the smooth operation of the tour or the enjoyment and safety of other passengers. Journey Intels will not be liable for damages due to such withdrawal.
  • 53.2 Holiday Insurance:
     Users are required to purchase holiday insurance as a mandatory condition of booking.
  • 53.3 Transfer of Tour:
     Transferring from one tour to another before departure is considered a cancellation of the original tour and will attract cancellation charges as outlined, with a new booking required at prevailing rates.
  • SELF-DRIVE CABS
  • DEFINITION
  • 54.1 Cab Definition:

  • 55.1 Facilitation Role:
     Journey Intels does not offer or provide self-drive cab services but acts as a facilitator to enable Users to book self-drive cabs with service providers. The service contract is between the User and the Operator. Journey Intels lists cabs provided by various Operators and is not considered an Operator under the Motor Vehicles Act, 1988, and the Rent a Cab Scheme, 1989.
  • 55.2 Booking Confirmation:
     Journey Intels shares a confirmation voucher based on the confirmation received from the Operator. The booking is subject to the User agreeing to the Operator’s terms and conditions, including presenting original identification documents and a valid driving license.
  • 55.3 Hand-over and Pick-up:
     The hand-over and pick-up of cabs are managed by the Operator. Any issues during pick-up or disputes regarding cab damage must be resolved between the User and Operator. Additional charges or deductions are determined by the Operator.
  • LIMITATION OF LIABILITY
  • 56.1 Operator’s Responsibility:
     The Operator is responsible for ensuring that all licenses, approvals, insurance, and permits required to rent a cab are obtained. Journey Intels provides no warranty regarding these requirements.
  • 56.2 Claims and Accidents:
     Journey Intels is not liable for any claims related to timeliness, safety, quality, condition of cabs, booking cancellations by the Operator, or any incidents resulting in damage, injury, or loss of life. In case of a breakdown or accident, Journey Intels' liability is limited to providing a proportionate refund, subject to receiving the refund from the Operator.

  • 57.1 Operator Terms:
     Bookings are also subject to the terms and conditions of the respective Operator. Currently, only certain Operators like Revv and Zoomcar list their cabs on Journey Intels’ platform. User-related terms for each Operator are provided in the links below:

  • 58.1 Additional Charges:
     In addition to the booking charges by the Operator, Journey Intels may charge a convenience or service fee. This fee covers the cost incurred by Journey Intels in facilitating the booking and is non-refundable.
  • 58.2 Payment Handling:
     The amount collected by Journey Intels for a booking is passed on to the Operator, and Journey Intels is not an Operator despite collecting payment.
  • 58.3 Final Amount:
     The final amount is calculated based on the verification of the vehicle at the time of return. Any applicable refunds will be processed based on the information received from the Operator.
  • 58.4 Security Deposit:
     A security deposit must be paid at the time of booking. The terms for the refund of this deposit are governed by the Operator's terms.
  • 58.5 Additional Expenses:
     Users are responsible for expenses such as toll charges, permit charges, parking charges, entry fees, service tax, and any government taxes. Penalties for traffic rule violations are also the User’s responsibility.
  • PAYMENT OF THE TOUR COST
  • 48.1 Payment Schedule:
     Payment for the tour shall be made according to the payment schedule provided in the brochure, email, or any other documented information communicated at the time of booking.
  • 48.2 Payment Methods:
     Payments can be made either online or via demand draft (DD) or cheque as specified to the User.
  • 48.3 Currency:
     Payments can be made in INR or any other foreign exchange/currency, as specified in the brochure or other documented information provided at the time of booking. Journey Intels relies on various outbound service providers and independent contractors for planning the tour.
  • 48.4 Dishonored Cheques:
     If a cheque towards payment is dishonored, Journey Intels reserves the right to cancel the entire booking without notice and without any liability, and will pursue appropriate legal remedies.
  • 48.5 Final Documents:
     Final documents and airline tickets will be provided only after the balance payment is received. For payments amounting to Rs. 25,000/- or more made by cash, a PAN card copy will be required.
  • 48.6 Foreign Exchange Component:
     For calculating the cost of the tour or refunds, the foreign exchange components will be based on the prevailing exchange rate on the day of calculation. Any fluctuations in the rate of exchange may affect the cost of the tour or the refund amount, which the User must bear.
  • 48.7 Invoice Breakdown:
     Journey Intels is not obligated to provide a breakdown of the invoice for each service included in the package.
  • REFUNDS
  • 49.1 Refund Facilitation:
     Journey Intels acts as a facilitator for refunds. Refunds for services not delivered by the service provider or independent contractors are subject to Journey Intels receiving the amount from these providers. Journey Intels is not liable for delays or non-refunds by service providers, and Users must approach the service provider directly for claims.
  • 49.2 Accommodation Changes:
     No refunds or compensations will be provided if Users make changes to their accommodation while on the tour. Any additional sums required due to these changes must be paid by the User.
  • 49.3 Delay in Refunds:
     If a refund is delayed beyond the specified period, Journey Intels' liability is limited to the refund amount with interest calculated at the applicable bank rate until the refund is made.
  • AMENDMENTS
  • 50.1 Tour Amendments:
     If Journey Intels amends or alters any tour or holiday after booking, the User may choose to continue with the amended tour or accept an alternative tour offered by Journey Intels.
  • 50.2 Liability for Amendments:
     Journey Intels will not be liable for any damage, additional expenses, or consequential losses suffered due to amendments. The liability is limited to refunding the tour cost after deducting actual expenses incurred by Journey Intels (e.g., visa, insurance premiums, other charges) without interest.
  • PROMOTION & DISCOUNTS
  • 51.1 Promotions and Discounts:
     Journey Intels may offer promotions and discounts on tour packages through advertisements or internal schemes. Users in group tours may receive additional benefits based on such promotions. Claims for discounts or promotions not received due to ineligibility will not be entertained.
  • 51.2 Withdrawal of Schemes:
     Journey Intels reserves the right to withdraw any travel scheme or discount at any time.
  • TOUR ARRANGEMENTS & OTHER ACTIVITIES
  • 52.1 Terms and Conditions:
     For arrangements such as carnival, cosmos, star cruises, amusement parks, museums, etc., the terms and conditions specified by the respective entities will apply.
  • 52.2 User Responsibility:
     Users must reach the commencement place of the tour and register with Journey Intels’ representative, tour guide, or tour manager at the appointed place, date, and time.
  • 52.3 No Show Policy:
     If a User avails pre-tour services or air tickets included in the main tour cost but fails to join the group for the main tour or cancels after using these services, it will be considered a "no show," and no refund will be provided for unutilized pre-tour or main tour services.
  • 52.4 Liability for Activities:
     Journey Intels is not liable for any health, safety, or well-being hazards associated with activities including adventure sports, amusement parks, rides, ferry rides, sightseeing, or any activity undertaken during the tour or independently. Any incidental damage, loss, injury, or death is the sole responsibility of the User.
  • MISCELLANEOUS
  • 53.1 Withdrawal of Tour Membership:
     Journey Intels reserves the right to withdraw tour membership from any User whose behavior affects the smooth operation of the tour or the enjoyment and safety of other passengers. Journey Intels will not be liable for damages due to such withdrawal.
  • 53.2 Holiday Insurance:
     Users are required to purchase holiday insurance as a mandatory condition of booking.
  • 53.3 Transfer of Tour:
     Transferring from one tour to another before departure is considered a cancellation of the original tour and will attract cancellation charges as outlined, with a new booking required at prevailing rates.
